I used a shipping service to send my Paladin brush from the U.S. to Canada. I had to pay tax, duties and Canada Post delivery charges to receive my brush from the shipping warehouse in Toronto, but it was well worth it.

On the customs form list the shipment as "brush" don't specify anything else about the brush. Value it at $50 and list it as a gift. You should sail through customs then. I've done this several times without a problem.

There are no issues with individual seller/buyers sending animal hair brushes from U.S. to Canada (and vice versa). The restrictions only apply to retailers (they are required to get a special permit).

The distinction is between commercial and non-commercial transactions, not retail vs. non-retail. In any case, the law is absurd and mainly observed in the breach, and I've never heard of an single instance of enforcement involving a badger-hair shaving brush.
1) If you visited my home from England, you could bring a brush and take it back with you, no problem. That's clear.
2) If you visited my home from England and left your brush behind, I'd have no concern sending it to you in England without making any declaration.
3) If you lived in England, and I wanted to give you a brush for your birthday, I wouldn't hesitate to do that.
The law as I read it doesn't expressly permit 2) or 3), but since no commercial transaction is involved, I'd apply conservative construction.
But there's no way around it for me if you pay me for a brush.
That said, I wouldn't worry about buying or selling a brush in a private transaction.
The exposure and stakes are very different for me running a business with my son, especially when I'm a recovering lawyer (who wouldn't expect to catch any breaks) and am already on the US F&WL radar having had many discussions with US F&WL agents on this subject.
The law as it stands effectively obstructs US makers from selling shaving brushes to ex-US markets. I don't see any evidence of it operating to that effect in the other direction. Who in the US has ever encountered a problem buying a brush from a maker/vendor outside the US and having it shipped here?
